You agree

When you sign up for a tour you agree to all the General, Reservation & Payment, Cancellation & Insurance conditions included in our Guided Tours -Terms and Conditions. When you sign our booking form or check online “I confirm that I have read the terms and conditions and agree”, this constitutes your acceptance of the terms and conditions set out by Caspin Journeys for yourself and on behalf of everyone in your party.

Health and fitness

For full enjoyment of Caspin Journeys guided tours, a certain degree of health and fitness is required. When you sign up it is on the understanding that you are in normal good health and you are confirming that you are physically and mentally able to participate in the activity you have chosen. If you have a pre-exisiting condition which would cause there to be any doubt as to your health and fitness, it is your responsibility to provide us with a doctors certificate approving your health and safety to participate in the tour for which you have signed up.

Risk responsibility

As is the case with any activity there are potential risks. Therefore, when you sign up for a tour you confirm that you are aware of the type of activity and its potential risks. When you sign up you are confirming that you are aware of the potential risks of travel and related activities and that you are willingly and knowingly electing to participate in this tour in spite of the potential risks. You are also confirming that you take full responsibility for any injury, loss or damage suffered by you, whether caused by you or anyone else.

Code of conduct

When you sign up for one of our tours, you agree to act sensibly and prudently and comply with local codes of conduct at all times; you also agree to abide by the decision of your Caspin Journeys guide at all times. If you commit a crime or behave in such a way as to endanger the safety or welfare of yourself or anyone in the party, our guides have the right to ask you to leave the tour immediately and there will be no refund payable.

Itinerary changes

It is unlikely that we will have to make any changes as we carefully plan and organize our schedules. We nonetheless reserve the right to alter a tour itinerary, for example due to unforeseen circumstances, adverse weather or similar considerations, or if we consider it necessary or for any other reason and at any time.

Your liability

You are aware and understand that you are liable for any damage or injury caused by you or anyone in your party whether intentional or unintentional and that you will indemnify Caspin journeys, the person or business damaged or injured for any costs, losses or damages they may incur.

Limitation of liability

Caspin Journeys purchases transportation, accommodations, restaurant services and other services from various independent suppliers that are not subject to its control – henceforth to be known as third party suppliers. Neither Caspin Journeys, nor  its employees shall be liable for any act, default, injury (including death), loss, expense, damage, deviation, delay, curtailment or inconvenience caused to or suffered by any person or their property, however arising, as a result of Caspin Journeys using third party suppliers. You further understand that Caspin Journeys neither owns nor operates such third party suppliers and accordingly agree to seek remedies directly and only against those suppliers and not hold Caspin Journeys responsible for their acts or omissions.

Data Protection

In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs/dietary requirements etc.
We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your travel arrangements such as hotels, transport companies etc. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law. We will not however, pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, we cannot provide your booking. In making this booking, you consent to this information being passed on to the relevant persons.)

Disputes

The person signing the booking form (which incorporates these booking conditions) warrants that they are fully aware of and accepts these conditions. Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the LCIA, London Court of International Arbitration Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Kenilworth, United Kingdom. The language to be used in the arbitral proceedings shall be English. The governing law of the contract shall be the substantive law of England and Wales.

Departures – guaranteed

Don’t worry; we will never cancel your tour due to lack of participation. When you book with Caspin Journeys you have peace of mind that your tour is guaranteed from the moment you receive our confirmation.

Transferring to another tour

Up to 76 days prior to the start of a tour you may transfer your reservation, depending on availability, from one tour to another in the same calendar year. All transfers incur an admin charge. Your final balance will reflect the admin charge and may also change to reflect the tour you have transferred to. Please notify us in writing and we will do our best to accommodate your wishes.

  • Transfer admin fee:    €/£ 50

Price and reservation

Our prices are correct at time of publishing and are quoted in the currency of the country in which the tour is operating. Caspin Journeys reserves the right to make price changes. Once a reservation has been confirmed by us in writing, the quoted price to the customer is guaranteed for that booking.

To make a tour reservation you must send us your booking form and the relevant deposit. On receipt of these we will advise you (normally within 10 days) that your reservation has been confirmed. Payments are due as follows:

  • Deposit due on booking: 15%
  • Balance due 75 days before the tour start date: 85%
  • If you book < 76 days before a tour start date payment is due in full on booking: 100%

Methods of payment accepted

  • credit card online (recommended) ; we accept Visa, Mastercard and Maestro symbols
  • international wire transfer; please send cleared funds (specify `OUR` to your bank) with no receiver fees

Important – Travel Insurance – Don’t leave home without it!

It is your responsibility to take out comprehensive travel insurance when you book to cover cancellation, illness and accident and liability. We also recommend you take out insurance to cover personal belongings for the duration of the holiday. Caspin Journeys is not responsible for any loss or damage to your luggage or personal property, nor for any other loss, damage, inconvenience, delay, illness, fatal or other injury, suffered by you as a result of making a reservation, or during your holiday.

30 days to change your mind! Only with Caspin Journeys !

If you are booking more than 105 days in advance, you may cancel your reservation within the first 30 days of booking and receive a refund minus only a small charge.

Cancellation by you

When you sign up for a tour you are responsible for taking out comprehensive cancellation insurance for all members of your party. If you cancel your booking, you must advise Caspin Journeys in writing (we accept email/fax), the letter being signed by the person who signed the original booking form. Refunds are calculated based upon the date that we receive the cancellation notice and according to the refund policy set out below.

Our refund policy:

  • Cancellation notified within the first 30 days of booking – Only a €/£50 fee and admin charge
  • Cancellation notified 76 or more days before tour start date – Only the deposit is forfeit
  • Cancellation notified 75-31 days before tour start date – You get a 50% refund of the full tour price
  • Cancellation notified 30-0 days before tour start date – Sorry, no refund
  • N.B. All refunds are subject to a €/£50 administration charge

Cancellation or alteration by us

We will never cancel your reservation due to lack of participation. It is also unlikely that we will have to make any changes to your tour, as we carefully plan and organize our schedules. However, we reserve the right to cancel a tour if we consider it necessary (e.g. force majeure) and at any time and for any other reason, although obviously we will endeavor not to do so. If we cancel your reservation, you may choose between receiving a full refund or transferring to another tour in that year with availability. If you choose to transfer to another tour you may be entitled to a partial refund or required to pay a difference.
